What is a County Court Judgment (CCJ)

As a creditor, you can apply for a CCJ when other methods of recovery have failed. The case is taken to a county court, where evidence is provided to the court to legally confirm the debt – Doing this allows for legal action to be taken. Once the debt has been confirmed, the debtor is notified, however, if no response is obtained within 14 days of serving the notice, a default judgment may be issued. This judgment results in the creditor winning the case by default, enabling a CCJ to be actioned. 

The Process

CCJs legally obligate the debtor to pay off the debt outlined in the county court case. The judgment allows you as a creditor to use enforcement methods to obtain the debt if the debtor still fails to pay; enforcement methods include actions such as sending bailiffs to the debtor’s property or deducting the debt from the debtor’s wage. If the CCJ is approved, it remains on the debtors’ credit file for six years, making it more difficult for them to borrow money in the future.
